Terms of Service

Effective May 11, 2026

These Terms of Service (“Terms”) govern your access to and use of iPropTrack (the “Service”), operated by iPropTrack (“we,” “us,” or “our”). By creating an account, signing in, or using any part of the Service, you agree to these Terms and to our Privacy Policy and Legal Disclaimer.

1. Description of the Service

iPropTrack is a software service that helps individuals and businesses track the public status of their United States patent and trademark filings. The Service pulls information from the USPTO's public APIs (ODP and TSDR), computes upcoming deadline windows based on general USPTO rules, and sends reminder notifications by email.

2. Eligibility and Account Registration

You must be at least 18 years old (or the age of majority in your jurisdiction) and able to enter into a binding contract to use the Service. By creating an account, you represent that the information you provide is accurate and that you will keep it up to date.

You are responsible for all activity on your account, including maintaining the confidentiality of your sign-in credentials and any third-party authentication method (such as Google OAuth) used to access the Service. Notify us immediately of any unauthorized use of your account.

3. Subscription Plans, Billing, and Refunds

The Service is offered under tiered plans, including a free tier and paid subscription tiers. Current plan limits and pricing are shown on our pricing page.

  • Billing. Paid subscriptions are billed in advance on a recurring basis through our payment processor, Stripe. By subscribing, you authorize us (through Stripe) to charge your payment method for each renewal until you cancel.
  • Renewals. Subscriptions renew automatically at the end of each billing period unless you cancel before the renewal date.
  • Cancellation. You may cancel at any time from your account settings or through the Stripe Customer Portal. Cancellation takes effect at the end of the current billing period; you retain access to the paid features until then.
  • Refunds. Except where required by applicable law, fees are non-refundable. We do not provide refunds for partial subscription periods, downgrades, or unused features.
  • Downgrades. If you downgrade or cancel, you keep access to any filings already tracked, but the Service may prevent you from adding new filings beyond the limit of your current tier until you upgrade again or remove existing filings.
  • Price changes. We may change subscription pricing from time to time. Price changes will not affect your current billing period and we will notify you before any change applies to a renewal.

4. Acceptable Use

You agree not to:

  • Use the Service to violate any applicable law or regulation, or to infringe the rights of any third party.
  • Reverse-engineer, decompile, scrape at high volume, abuse our rate limits, or otherwise attempt to extract the Service's source code or underlying data structures.
  • Use the Service to send spam, transmit malware, conduct denial-of-service attacks, or otherwise harm the Service or its users.
  • Resell, sublicense, or commercially exploit the Service except as expressly permitted by a separate written agreement with us.
  • Submit information about a filing for which you do not have the owner's permission to track.

We may suspend or terminate accounts that, in our reasonable judgment, violate these Terms.

5. USPTO Data and User Content

The Service displays information drawn from public records published by the USPTO. The USPTO is the authoritative source for that information; anything iPropTrack displays is, at best, a mirror of those records as of the most recent sync and, at worst, may be delayed, incomplete, or inaccurate. We do not warrant that information shown on iPropTrack matches the USPTO's current records.

Any content you submit to the Service (for example, the patent or trademark numbers you choose to track, notes you write, or contact information you provide) remains yours. You grant us a non-exclusive license to use that content solely to provide and improve the Service.

6. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” We disclaim all warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, and uninterrupted operation. We do not warrant that the Service will be error-free, that deadlines or status information will be correct, or that notifications will be delivered on time. 7. Limitation of Liability

To the maximum extent permitted by law:

  • iPropTrack and its operators, affiliates, employees, contractors, and licensors shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, intellectual property rights, goodwill, or business opportunities, arising out of or relating to your use of (or inability to use) the Service.
  • Specifically and without limitation, we are not liable for missed deadlines, unpaid maintenance or renewal fees, lapsed registrations, abandoned applications, missed office-action responses, missed §8/§9/§15 windows, surcharge fees, USPTO petition fees, attorney's fees, or any other consequence relating to your patents, trademarks, or other intellectual property — regardless of whether the Service correctly identified, computed, displayed, or notified you about the relevant date.
  • In any case, our aggregate liability for all claims arising out of or relating to the Service will not exceed the greater of (a) the amount you paid us for the Service in the 12 months preceding the event giving rise to the claim, or (b) USD $50.

Some jurisdictions do not allow the exclusion or limitation of certain damages, so the above limitations may not apply to you in full.

8. Indemnification

You agree to defend, indemnify, and hold harmless iPropTrack and its operators from any claim, demand, loss, liability, damage, or expense (including reasonable attorney's fees) arising out of (a) your use of the Service, (b) your violation of these Terms, (c) your violation of any law or the rights of any third party, or (d) any content you submit to the Service.

9. Termination

You may stop using the Service at any time. We may suspend, restrict, or terminate your access to the Service at any time, with or without notice, if we reasonably believe you have violated these Terms or for any other lawful reason. Upon termination, your right to use the Service ends immediately, but the provisions of these Terms that by their nature should survive (including disclaimers, limitations of liability, indemnification, and governing-law clauses) will survive.

10. Changes to the Service or These Terms

We may modify, add to, or discontinue features of the Service at any time. We may also modify these Terms; if we do, we will update the effective date at the top of this page and, for material changes, provide additional notice (such as an email or an in-app banner). Continued use of the Service after a change becomes effective constitutes acceptance of the updated Terms.

11. Governing Law and Disputes

These Terms are governed by the laws of the State of New York, USA, without regard to conflict-of-law principles. Any dispute arising out of or relating to these Terms or the Service will be resolved exclusively in the state or federal courts located in New York County, New York, and you and we consent to the personal jurisdiction of those courts.

12. Miscellaneous

  • Entire agreement. These Terms (together with our Privacy Policy and Legal Disclaimer) constitute the entire agreement between you and us regarding the Service.
  • Severability. If any provision of these Terms is held invalid or unenforceable, the remaining provisions will continue in full force.
  • No waiver. Our failure to enforce any provision is not a waiver of that provision.
  • Assignment. You may not assign these Terms without our prior written consent. We may assign these Terms freely.
